I am in need of some good legal advice, can someone help me?

my husband has had several offers of employment and they have been withdrawn because of a job reference from 10 years ago. The ex sales manager has lied to his prospective employers by claiming that he had over $50,000 in chargebacks which it was $25,000 and he was honest with them as to the reasons why this occurred, so far it has been 5 bad references. I thought it was against the law to give specific details and more so to slander him this way, what can we do legally about this?I am in need of some good legal advice, can someone help me?
It is not against the law in all states to provide negative information on a past employee. Illinois, for example, in 1997 enacted a law that allows the previous employer to say just about anything they want as long as it is their belief that it is true.





You probably can file a civil suit against the sales manager for what he has said. An attorney may also be able to, in a letter, require that this person cease %26amp; desist spreading the lies. Sometimes a former employer will provide a ';neutral letter of recommendation'; which has the dates the employee worked and his title, rather than face a lawsuit. On the negative side, such a lawsuit can be expensive and unless the employers that rejected your husband will testify to what the prior employer said you may be out of luck.





Is there someone else that could provide your husband with a reference for this job. Perhaps the head of Human Resources or someone that he worked with who liked him. Many times when there is animosity over an employee leaving a company, his direct manager will purposely provide negative references just to get even with the employee for leaving. For most of my clients, we find another person who can provide a reference for that job and then give that person's name and phone number to prospective employers.

You need to approach a civil attorney and prove that each job that refused to hire him didnt hire him because of that particular reference. Also why would he still be using the person as a reference, if the guy was doing that. It wont make it through court, as slander. maybe defamation but then again he had 35k in chargebacks already. It has to be more than what is being stated. Just ask an attorney though to be positive since they do free consultation what can it hurt. GOOD LUCK
